Regulamin świadczenia usług drogą elektroniczną Fundacji ERA
I. Postanowienia ogólne
1. Regulamin określa zasady korzystania ze strony internetowej lesnastacja.pl oraz zasady świadczenia usług drogą elektroniczną przez Fundację Ekologia Rozwój Aktywność ERA z siedzibą w Leśnej Hucie 4, 83-262 Kaliska, wpisaną do KRS pod numerem 0001040741, NIP: 5922294484 (dalej: „Fundacja” lub „Usługodawca”).
2. Korzystanie z serwisu oznacza akceptację niniejszego Regulaminu.
3. Regulamin dostępny jest nieodpłatnie w formie elektronicznej na stronie internetowej, w sposób umożliwiający jego pobranie, utrwalenie i wydrukowanie.
II. Definicje
Na potrzeby Regulaminu:
• Usługobiorca/Klient – osoba fizyczna, prawna lub jednostka organizacyjna korzystająca ze strony i usług Fundacji.
• Konsument – osoba fizyczna dokonująca czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową.
• Usługi – usługi świadczone drogą elektroniczną przez Fundację, w tym m.in. możliwość rezerwacji usług edukacyjnych, noclegowych, udziału w wydarzeniach i dokonywania płatności online.
• Regulamin – niniejszy dokument.

IV. Płatności
1. Płatności (np. za usługi noclegowe, cateringowe, pobyty zorganizowane, udział w zajęciach, darowizny) mogą być dokonywane online za pośrednictwem udostępnionych operatorów płatności, w tym za pośrednictwem linku do płatności wysyłanego na maila.
V. Warunki zawierania i rozwiązywania umów
1. Zawarcie umowy o świadczenie usług drogą elektroniczną następuje z chwilą rozpoczęcia korzystania z serwisu.
2. Umowa zostaje rozwiązana z chwilą zaprzestania korzystania z serwisu przez Usługobiorcę lub usunięcia jego danych.
VI. Płatności
1. Płatności (np. za usługi noclegowe, cateringowe, udział w zajęciach, darowizny) mogą być dokonywane online za pośrednictwem udostępnionych operatorów płatności.
2. Wszystkie ceny podawane są w złotych polskich i zawierają podatek VAT, jeśli dotyczy.
VII. Prawo odstąpienia od umowy
1. Konsument ma prawo odstąpić od umowy zawartej na odległość w terminie 14 dni, bez podania przyczyny, zgodnie z ustawą o prawach konsumenta.
2. Wyjątki od prawa odstąpienia przewidziane w ustawie (np. usługi wykonane za wyraźną zgodą konsumenta, usługi zakwaterowania w oznaczonym terminie) mają zastosowanie.
3. W przypadku o odstąpienia od umowy w postaci zwrotu kosztów Sprzedawca dokona zwrotu płatności przy użyciu takiego samego sposobu zapłaty, jakiego użył Klient, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami.
4. W przypadku uznania reklamacji w postaci zwrotu kosztów Sprzedawca dokona zwrotu płatności przy użyciu takiego samego sposobu zapłaty, jakiego użył Klient, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami.
VIII. Reklamacje
1. Usługobiorca może zgłaszać reklamacje dotyczące usług drogą elektroniczną na adres e-mail: biuro@lesnastacja.pl.
2. Fundacja rozpatruje reklamację w terminie 14 dni od jej otrzymania i informuje Usługobiorcę o decyzji.
IX. Ochrona danych osobowych
1. Administratorem danych osobowych jest Fundacja ERA.
2. Dane osobowe przetwarzane są zgodnie z RODO w celu realizacji usług oraz w celach określonych w Polityce Prywatności dostępnej na stronie internetowej.
3. Każdemu Usługobiorcy przysługują prawa wynikające z przepisów o ochronie danych osobowych, w tym prawo wglądu, sprostowania, usunięcia i ograniczenia przetwarzania danych.
X. Postanowienia końcowe
1. W sprawach nieuregulowanych Regulaminem stosuje się przepisy prawa polskiego, w szczególności Kodeksu cywilnego oraz ustawy o świadczeniu usług drogą elektroniczną.
2. Fundacja zastrzega sobie prawo zmiany Regulaminu z ważnych przyczyn, o czym poinformuje Usługobiorców poprzez publikację nowej wersji na stronie internetowej.
Terms and Conditions for the Provision of Electronic Services by the ERA Foundation
I. General Provisions
These Terms and Conditions set out the rules for using the website lesnastacja.pl and the rules for the provision of electronic services by the ERA Foundation for Ecology, Development and Activity, with its registered office at Leśna Huta 4, 83-262 Kaliska, entered in the National Court Register (KRS) under number 0001040741, NIP: 5922294484 (hereinafter referred to as the “Foundation” or the “Service Provider”).
Use of the website implies acceptance of these Terms and Conditions.
The Terms and Conditions are available free of charge in electronic form on the website, in a manner that allows them to be downloaded, saved, and printed.
II. Definitions
For the purposes of these Terms and Conditions:
• Service Recipient/Client – a natural person, legal entity, or organizational unit using the Foundation’s website and services.
• Consumer – a natural person performing a legal transaction not directly related to their business or professional activity.
• Services – electronic services provided by the Foundation, including but not limited to: booking educational services, accommodation, participation in events, and making online payments.
• Terms and Conditions – this document.

IV. Payments
1. Payments (e.g., for accommodation, catering, organized stays, participation in activities, donations) can be made online via the provided payment operators, including via a payment link sent via email.
V. Terms of Conclusion and Termination of Agreements
1. An agreement for the provision of electronic services is concluded at the moment the Service Recipient begins using the website.
2. The agreement is terminated when the Service Recipient ceases to use the website or their data is deleted.
VI. Payments
1. Payments (e.g. for accommodation, catering services, participation in events, donations) may be made online via the payment operators made available.
2. All prices are quoted in Polish zlotys (PLN) and include VAT, where applicable.
VII. Right of Withdrawal
1. The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with the Consumer Rights Act.
2. Exceptions to the right of withdrawal provided for by law (e.g. services performed with the explicit consent of the Consumer, accommodation services for a specified date) apply.
3. In the event of withdrawal from the contract in the form of a refund, the Seller shall return the payment using the same means of payment as those used by the Customer, unless the Customer expressly agrees to a different method of return which does not involve any costs for them.

VIII. Complaints
1. The Service Recipient may submit complaints regarding services provided electronically to the following e-mail address: biuro@lesnastacja.pl.
2. The Foundation shall consider the complaint within 14 days of its receipt and inform the Service Recipient of its decision.
IX. Personal Data Protection
1. The administrator of personal data is the ERA Foundation.
2. Personal data is processed in accordance with GDPR for the purpose of providing services and for other purposes specified in the Privacy Policy available on the website.
3. Each Service Recipient has the rights arising from data protection legislation, including the right to access, rectify, delete, and restrict the processing of their data.
X. Final Provisions
1. Matters not covered by these Terms and Conditions are governed by Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services.
2. The Foundation reserves the right to amend the Terms and Conditions for valid reasons, of which Service Recipients will be informed through the publication of a new version on the website.
